So was this nickel ever considered legal tender?

Probably not. Since the coins were struck in secret and put away, it's unlikely that the issue would come up until it became known that they existed, then they would be part of an unauthorized issue.

 

Imagine the conspirators striking a few thousand of them and releasing them into circulation.....now that would be something cool like the unintentional striking of an unknown number of 1943 bronze cents.
